Terms and conditions

The purpose of this Online Planning Register is to enable any person to check that a planning permit application has been lodged, the location of proposed land development or use and the outcome of any assessment of a planning permit application.

DISCLAIMER: It may take several days for an application for permit made to Council to appear in the register. The non-appearance of an application does not mean that an application has not been made. Accordingly, no warranty or guarantee is given by council as to the accuracy of the register and no reliance shall be placed on it.

Boroondara City Council (Council) is the responsible authority with respect to land use and development planning within its municipal district in accordance with the Boroondara Planning Scheme. Land use planning controls are governed by the Planning and Environment Act 1987 (the P&E Act).

Under Section 49 of the P&E Act the responsible authority must keep a register of:

  • all applications for permits
  • all decisions and determinations relating to permits.

Section 49 of the P&E Act also requires the responsible authority to make the register available during office hours for any person to inspect free of charge.

The information in this Online Planning Register has been collected by Council in accordance with its statutory obligations under the P&E Act.

Council must also comply with the Privacy and Data Protection Act 2014 and this extends to public registers, such as under s.49 of the P&E Act, where Council must, so far as is reasonably practicable, ensure that there is no contravention of an Information Privacy Principle under the IP Act in relation to personal information held on public registers.

While the Online Planning Register is available to any person, it may amount to an interference with the privacy of an individual for a person to access this Online Planning Register to do an act or engage in a practice that would contravene an Information Privacy Principle under the IP Act with respect to the personal information on the Register, including but not limited to, accessing the Online Planning Register in order to identify and market products or services to a section of the register that meets a particular socioeconomic profile.

A condition of use of this Online Planning Register is that you will not use the personal information in any manner that may amount to an interference with the privacy of an individual generally or to facilitate direct marketing to a property where an entry for that property does not show consent to receive direct marketing at that address specifically.

The advertising material has been lodged by the permit applicant, in support of their application, under section 47 of the Planning and Environment Act 1987.

Council has not made a decision on the application.

The advertising of an application, or the material being advertised, does not indicate Council support of an application.
